C20 STUDIES TERMS AND CONDITIONS       updated 19th December, 2015

By engaging the services of Richard Gibbons working as C20 Studies, clients confirm that they have agreed to the following Terms & Conditions. Clients will be required to sign two copies or an electronic copy of these Terms & Conditions in advance of any work in order to confirm this acceptance.

PRIVATE TUITION

Location

1) C20 Studies offers private tuition in English, English Literature, 20th Century History and Study/Examination Skills to students aged 11 and over at Key Stage 3, GCSE, AS, A and post-A levels. Also offered are non-examination courses.

2) This tuition is generally available a) in the UK on-line,  b) by student visit in person to C20 Studies

3) Clients make no commitment to C20 Studies other than to pay for tutoring received. All appointments are agreed individually in advance.

Safeguarding Conditions:

For the protection of students and tutor:

4) Tutor visits to student: if the student is under 18 years of age or judged by C20 Studies to be otherwise ‘vulnerable’, a responsible adult must be present within the property at all times, with inter-connecting doors remaining open at all times.

5) Student visits to tutor: if the student is under 18 years of age or judged by C20 Studies to be otherwise ‘vulnerable’, a responsible adult must remain at the property at all times, with inter-connecting doors remaining open at all times. C20 Studies provides a comfortable lounge with tv for accompanying adults.

6) Electronic communication: If a student is under 18 or otherwise judged by C20 Studies to be vulnerable, any e-mail communication will be undertaken strictly only on the following terms: e-mails from students must either be sent from an e-mail address to which a responsible adult has access OR copied to such an address. E-mail communication to a student from C20 Studies will be sent only to an e-mail address to which a responsible adult has access OR copied to such an address. Any other form of electronic communication must take place ONLY if the student has a responsible adult in the same room as him/her throughout.

If at any point the conditions described above cease to exist, the tutor will immediately conclude the session. Full payment for the whole session as agreed will be required.

Fees

7) Per hour or part-hour:
Students aged 11 up to and including GCSE/comparable levels:£20.00
Students at AS/A/comparable levels:£25.00
Students at post-A level:£25.00
Adult non-examination courses:£20.00
Professional training & support:£25.00
8) In addition to the above, if the tutor travels to the student, travelling expenses may be added, by negotiation.

Payment

9) All payments will be due in full immediately following the conclusion of each session. Payments for non-on-line sessions may be made by cheque payable to “C20 Studies” or in cash. Receipts will be provided.

10) Payments for on-line sessions will be made via PayPal.

11) If payment is not made following a session, C20 Studies may consider the agreement to provide services broken and will cancel all future arrangements.

12) Small group tuition may be available at reduced cost to individual students, by negotiation.

Attendance

13) Arrangements for session dates and times will be agreed in advance. It is expected that both tutor and student will attend (or be on-line for) sessions at the times agreed in advance.

14) The tutor will make every possible effort to attend/be on-line for sessions agreed in advance. Should this not be possible for any reason, the tutor will cancel the date and attempt to re-arrange it. If this cancellation occurs less than 24 hours before the time of the session, the next session will be provided at 50% of the usual fee. Normal travel expenses will apply.

15) The student should make every possible effort to attend/be on-line for sessions agreed in advance. Should this not be possible, the tutor will attempt to agree an alternative date and time. If this cancellation occurs more than 24 hours before the time of the session, there will be no charge. If the cancellation occurs less than 24 hours before the time and date of the session, C20 Studies will charge 50% of the usual fee, which must be paid before the next session. C20 Studies retains the right to cancel any further sessions if students fail to attend.

16) In the event of a need to cancel, the tutor will make every reasonable effort to contact the student, and will expect the student to do the same in similar circumstances. Should it not be possible to make contact, C20 Studies will proceed on the basis of the arrangements for less than 24 hours’ notice in (14) and (15) above.

17) Special arrangements may be made in the case of any emergencies.

Materials and Liability

18) C20 Studies will provide basic worksheets and some textual material as appropriate; however, students will normally be expected to provide their own stationery and texts.To the maximum extent permitted by law, C20 Studies accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Tutor’s services or any errors or omissions in the content of the Tutor’s learning materials or teaching.

Reports and Progress

19) The tutor will provide regular verbal reports on the student’s progress to the student and, if the student is under 18, to the appropriate responsible adult.

20) Either tutor or client may cancel future arrangements at any point, in accordance with paragraphs 14 and 15, if they feel sufficient progress is not being made or is unlikely.

20th CENTURY HISTORY COURSES/EVENTS

General

21) C20 Studies can provide multimedia talks, events or seminars on World War II or the Cold War. Audiences can include schools (age 11 upwards), colleges, museums, clubs, societies, etc.

22) Clients have the right to change their mind and withdraw from a planned event without charge within 14 days of agreeing the event. This should be done by e-mail to c20studies@tiscali.co.uk or by letter (address available via 01354 688119).

Fees

23) One-hour sessions taken from a large range of prepared talks will be charged at £39.00 per hour or part-hour. A list is available of currently-available subjects.

24) Sessions on other 20th century topics may be available by special arrangement.

25) Travelling expenses at 25p per mile will be charged.

Attendance

26) The speaker will make every possible effort to attend events agreed in advance. Should this not be possible for any reason, the speaker will cancel the date and attempt to re-arrange it. If this cancellation occurs less than 24 hours before the time of the session, the next session will be provided at 50% of the usual fee. Normal travel expenses will apply.

27) The event organisers should make every possible effort to attend/prepare for sessions agreed in advance. Should this not be possible, the speaker will attempt to agree an alternative date and time. If this cancellation occurs more than 24 hours before the time of the session, there will be no charge. If the cancellation occurs less than 24 hours before the time and date of the session, C20 Studies will charge 50% of the usual fee, which must be paid before the next session. C20 Studies retains the right to cancel any further sessions in such circumstances.

28) In the event of a need to cancel, the speaker will make every reasonable effort to contact the organisers, and will expect the organisersto do the same in similar circumstances. Should it not be possible to make contact, C20 Studies will proceed on the basis of the arrangements for less than 24 hours’ notice in (14) and (15) above.

29) Special arrangements may be made in the case of any emergencies.

Equipment/accommodation

30) C20 Studies can provide all equipment necessary for events delivered for up to 50 people; however, it is always helpful if existing sound systems/screens can be used in the venue, especially for larger audiences.

31) Organisers should arrange venues in advance of the session, including furniture, refreshments and supervision.

32) The C20 Studies advisor will not deliver a session to school students unless school staff are present in the room at all times.

33) C20 Studies will need at least 30 minutes to prepare equipment in advance of a multimedia session.

34) All arrangements for sessions will need to be agreed in advance.

Intellectual property/copyright

35) C20 Studies will make every reasonable effort to ensure that material in their multimedia productions/events/seminars has an appropriate licence in the public domain/Creative Commons, is owned by the clients with permission given to use or is licensed to or owned by C20 Studies and that it infringes no personal or intellectual rights. If it can be demonstrated that this is not the case with any material, that material will immediately be removed from the programme/production.

General

36) C20 Studies can design and produce the following for schools, clubs, museums, societies and many other organisations:
  • video display material for events, exhibits etc
  • leaflets, pamphlets, guides, etc
  • DVD souvenirs for events, museums, etc
37) Clients have the right to change their mind and withdraw from a planned project without charge within 14 days of agreeing the event. This should be done by e-mail to c20studies@tiscali.co.uk or by letter (address available via 07757 310455).

Liability

38) C20 Studies will make every reasonable effort to ensure that all material produces by them is free of computer viruses, trojan horses, malware or any other harmful electronic components, but cannot be held responsible for any injury, damage or harm caused by clients’ use of such materials.

Payment

39) The price of projects must be agreed in advance. C20 Studies will provide a written quotation.

40) Payment will be by cheque payable to “C20 Studies”, via PayPal, by bank transfer or in cash.

41) One half of the total agreed fee will be paid before commencement of work. The other half will be due within 21 days of completion.

42) It is C20 Studies’ policy to take all appropriate action to recover payment for work undertaken. Accounts that remain unpaid beyond the 21 day period following completion of the work may be subject to a surcharge of up to £5.00 per full week until the account is paid in full.

EDUCATION CONSULTANCY

43) C20 Studies can offer an educational consultancy service to schools/parents/carers, councils in many areas, including:

  • complex investigations
  • assistance In negotiation
  • assistance in addressing, formulating and resolving complaints or concerns
  • providing independent investigation of many complaints within appropriate procedures
  • attendance at meetings
  • mediation/conciliation
  • school management support
  • governing body support
  • support for parents/carers in situations concerning academic progress, alleged bullying, special needs, etc

Note: all parties will need to agree with the C20 Studies advisor’s involvement.

44) These services are generally available a) on-line in the UK only, b) by advisor visit to locations within 50 miles of March, Cambridgeshire, UK, c) sometimes by advisor visit beyond the 50-mile limit on special terms agreed between client and C20 Studies.

45) Clients make no commitment to C20 Studies other than to pay for work the advisor has carried out. The advisor can provide estimates of the cost of individual pieces of work, but these may vary according to conditions/situations encountered.

Fees

46) Professional fees for services listed above except investigations will be agreed by negotiation. Additional charges may be made for travelling expenses/time.

47) The usual fee for carrying out investigations is £30.00 per hour, including travelling, calls, preparation and reporting. No extra fees will be charged except for special delivery postal costs.

Payment

48) Payment will be due monthly in arrears OR at alternative times by negotiation.

49 Payment will be due within 14 days of the invoice date..

50) If payment is not made by this date, C20 Studies may cancel all future arrangements.

51) It is C20 Studies’ policy to take all appropriate action to recover payment for work undertaken.

Attendance

52) If a client does not attend an agreed meeting and the advisor has attended, the usual professional fee for time taken will be due.

53) If a meeting is cancelled by a school, C20 Studies will try to re-arrange and there will be no charge to a parent/carer client in these circumstances.

General

54) Clients accept that the support given by C20 Studies does not constitute legal advice or legal support. Clients who require either of these should contact an appropriate legal professional.

55) Clients accept that, whilst C20 Studies will make every effort to help the client bring about satisfactory outcomes, these are not guaranteed and clients will not hold C20 Studies/the advisor responsible for any adverse outcomes or distress/injury caused as a result.

56) C20 Studies expects all participants in discussions/negotiations to behave in a positive and non-threatening manner. C20 Studies reserves the right to cancel any outstanding arrangements if it believes that this has not been the case. All outstanding fees will be immediately payable in such circumstances.

57) Clients engaging C20 Studies to work with schools on their behalf must a) have parental responsibility for the young person concerned b) not be subject to any court or other orders preventing or forbidding the processes for which they are engaging C20 Studies c) confirm by signing this document that (a) and (b) above apply d) give written permission for C20 Studies to obtain and examine any data/material relevant to the case in question.

58) Mediation/Conciliation: C20 Studies offers various models, but these are undertaken on the basis that, if the advisor feels at any stage that no resolution is possible, he will conclude the process. Payment for any work undertaken will be due at that point.

Information

59) C20 Studies obtains only information/data sanctioned by the owners of that information with their permission, and retains it only as long as necessary to carry out the work required by its clients and for twelve months thereafter, after which time information will be destroyed. Such information is used only to discharge the required actions of clients, and will not be passed to any other individual or agency without the owner’s permission and then for the purposes only of facilitating the tasks required by clients. Information gathered during investigations will be made available to the agency commisioning the investigation and, where appropriate, to any subsequent tribunals, courts or related investigations.

60) In accordance with the Data Protection Act, C20 Studies will disclose all and any personal information/data it holds to the owners of those data or that information if requested. Such requests should be made by e-mail to c20studies@tiscali.co.uk. A full response will normally be provided within ten working days.C20 Studies is registered as a data holder under the Data Protection Act. Reasonable charges may be made for collation, duplication or copying of such material.

* C20 Studies reserves the right to refuse or end services to any client who it feels does not reflect C20 Studies’ mission statement. In such circumstances any payments due for services rendered become immediately payable.

C20 STUDIES MISSION STATEMENT

Securing the Future: C20 Studies exists to further the causes of resolving conflicts and promoting local, national and international understanding, education, peace and co-operation. Richard will happily work with individuals/organisations that have similar views, but reserves the right to refuse to work, or to cease to work, with any whose views or approaches appear, in his view, not to be sympathetic with this principle.
